I didn't mean it as a woman joke. ;) Oddball stated it was a "she" that said all those crazy things about sending in income tax checks to the trustee (I almost fell from my chair I was laughing so hard on that one!).
yes thats cuz when a trustee is going to get paid he lists it as an asset case.
it flags it in his computer so that they can track it easier. when money is to be had tehn they want to keep their evil little pathetic greedy little shriviled pathetic eye on it.

Okay BKFILER, can I get that same guarantee!!! I have the same situation, and I've gotten my answer already. But, I just called my attorney's office for information, and thought I would just throw the question in anyways. My case was filed in June, discharged in October, and closed in November (blah, blah, blah). I know that the trustee would have mentioned it at the 341, or as my attorney's legal assistant said, I would have had a form to sign from the trustee that would have come with the original request for information from the trustee before the 341. She seemed shocked that I had not signed anything, and especially with this particular trustee. IMO, oh well!!! Her recommendation: "SEND THE TRUSTEE A COPY OF BOTH RETURNS; DO NOT GET DIRECT DEPOSIT, BUT SEND THE CHECK DIRECTLY TO THE TRUSTEE." If I do, will someone shoot me!!! I told her that my case was closed, and she said it doesn't matter, that the trustee could reopen the case, but it would cost like $200+ to do so. As I'm sitting here scratching my head, WHY WOULD I VOLUNTARILY DANGLE MONEY IN FRONT OF THE TRUSTEES FACE!!! She even tried to tell me that my case was not closed. I told her according to pacer it was. She said that pacer would likely update information for the request of tax returns. RIGHT!!!! My case is CLOSED.
I'll NOT do anything VOLUNTARILY.....LOL and unless this "assistant" sent you a letter, it's just something she said....wait and see if you get a request in writing...I would. Plus that sounds silly, why wouldn't your lawyer tell this?? ALSO your case id closed!!! I thought the only reason it is "held open " is if they trustee is waiting for something ....like a refund!!! Your case is closed, I would sit back and relax, I would!!!! If you still need a piece of mind.....ask you lawyer, NOT the assistant. Or call back and ask a question, and nonchalantly ask so everything is good and done? right..and see, If you case is flagged waiting for a refund they should tell you.
We live in Illinois, and I heard someone else from Illinois had the trustee tell them at the 341 to sign tax papers and that the trustee will take it. HOWEVER.....at our 341 the trustee didn't say anything about our refund. Our case was discharged and we are waiting closing. I called my lawyer to asked them our car situation, and i mentioned the tax refund, and they said no don't worry about it. The trustee would have but an objection in and not discharged us , if we wanted the return.
I for one am NOT going to voluntarily send the trustee info ...plus we go to Jackson Hewitt to do our taxes, we get the direct deposit. SSSOOOO we will just do things like we normally do!!
( unless we happen to hear otherwise, Which my lawyer doesn't think will happen at all.)
Okay...So I went back and checked Pacer to look at a couple of cases of people that I knew that filed, and had discharged/closed. I feel more at ease now. I checked flags. My flags are PreBAPCPA,CLOSED. That sounds like CLOSED to me. I'll be filing my return as planned, and I just might get extra gutsy and do Direct Deposit. I've completed a preliminary return online, and I'm only getting about $1500, plus I will owe the state close to $400. Income tax filing status: FILING AS USUAL!!! The trustee IMO gets none!!!!
BAPCPA = Bankruptcy Abuse Prevention and Consumer Protection Act of 2005
preBAPCPA would mean you filed before the change in laws.
strange how peoples accounts show different things and for who knows why. mine shows no flags at all, thank god!
