    A Creditor didn't get listed on filing

    I have a creditor that was not on my credit report and I forgot about the debt, so it didn't get listed on my bk filing. Is there anything I can do? Or does the filing include all my debt even ones that weren't listed? What can I do about this? What will happen with this debt?

    I found out because I received a collection letter today from them.

    341 Meeting ~ June 29, 2010
    Discharge ~ August 31, 2010

    Let the creditor know you filed BK and let your attorney know. Technically they are supposed to be listed and are supposed to receive service when the petition is filed. However, there is case law to support the fact that a debtor is protected from the creditor even if they are not listed. Obviously you arent gonna nab em for violating stay, but just let your attorney know and it should be OK.

      Talk to your attorney about it and it should be fine. I had one creditor that wasn't listed that I wasn't aware of when I filed. I told my attorney and he it took care of it. I haven't heard from them since.
