    Post discharge questions.........

    Hello all,

    I received my discharge for my Ch 7 no asset case on 1/18....wooo hoooo!!! Here is my question, I have a 2000 explorer, 1995 suburban and a 1995 mx6...I told the lawyer that I wanted to keep the mx6. Well, I haven't heard a thing from the trustee or anyone else about taking the trucks. They are both paid off, so I figured the trustee would have taken them. When will it be safe for me to sell these vehicles? I need to hire a tax lawyer to take care of some past due sales tax from my old restaurants, around $25000 which wasn't covered by the BK, and could really use the money. Also, now that my discharge is past, is it ok for me to get a REAL job? I've been working retail for the last two months because I didn't want to take a chance to have my case converted to a ch 13 because I made too much money. Thank you for your time and help.

      yes you can get a real job.

      hmmm, safe to sell vehicles... good question.

      if your case is still listed as No Asset and your attorney or the trustee hasnt contacted you yet I dont see a reason your cant sell them.

      And you are sure that you just aint forgetting something that someone told you right? like "Ill get those cars in February. Leave them alone." or nothing like that right?

        My paid off 2000 4runner...I do have a lien on the title to a member of my family that's over a year old (a year prior to bk filing)...the FL trustee is taking my tax refund...all of probably $450....now I'm betting he wants my SUV too.

        I've been discharged but have heard nothing on the truck...

          after discharge it went from no asset to asset?

          didnt they talk to you about that at the 341 though?

            at the 341 meeting the trustee confirmed that i had the vehicles but that was it. he didn't mention anything about when or if he would take them. i just figured i would have received a letter or phone call before my discharge.

                Mine went from "no asset" to "asset" before discharge...only thing I've received has been the request for me to send my big tax refund ($450) to the trustee...have heard nothing on the truck & was discharged on 1/17

                  ok thought so. this poster already had a discharge and case still listed as no asset. i think he is safe.

                    Ok, this is getting really confusing. I checked pacer out for the first time tonight just to see if my case was closed yet.....which it is not. But i couldn't help but notice "Trustee Report of No Distribution". I told them I had these extra vehicles, why would he not take them???

                        lol I didn't miss any letter that may have been sent to me. Since the day of my 341 meeting I was checking every single piece of mail that came to my apt. As far as the vehicles go....I'm guessing in as-is conidtion they probably have a value of $6000-7000 for both. My only guess would be the fact that both trucks need work before they can be driven, but I can't remember if I mentioned that to the trustee.

                          My 4runner needs a lot of work as well; trustee was informed at the 341 of needed repairs...maybe they don't want to deal with cars that need repair? I'm hoping but I don't think my case will be closed util 2/27 which is the date of the notice of creditors w/liens or something like that.
