Have been reading for some time now. Lots of great information. My husband filed chapter 7 under old bk laws, had his 341 Dec 29 no problems.(waiting for discharge) We live in Tx a joint debtor state, will chase and mbna credit cards come after me for the debt after he gets a discharge? One card i am a authorized user on and the other I'm not. Help please any advice is appreciated.

Where can I find out what can happen. I am sure that the vultures will be looking for anything they can find. I wish i'd been more proactive in this bk process but was told not to worry as it was his debt. he did use a bk attorney so i'm surprised he wasn't advised that we file jointly. Has anyone else been in this situation?

The AU doesn't matter... But TX is a community property state and therefore, you can be held responsible for your husband's debts. Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

So is my only option now to file bk too? obviously if he couldn't handle the payments me being a stay at home mom won't be able to either. What is the worst that the cc can do? i know in TX that they can't take your house or cars but can they put leins against them. what a frigging mess, my husband thoought that he was protecting me....................

I think a good first step is to consult w/ a BK attorney-even if just to find out for sure what the worst is if you don't file. Most of my information is from personal experience or HOURS and HOURS of online research.
