    Tax Refunds

    Let's say you've already had your 341 meeting and are awaiting the closure of your case. You file your taxes and find out you're getting a refund.

    How can the court find out about your refund? What is the likelihood of the court then taking that money? It would seem to me that any future windfalls would be out of their reach, especially if there was no mention of future cash inflows during your meeting with the trustee.

    if the trustee didnt ask then dont tell.

    he can find out by looking it up if he wants to. but again if he didnt ask then dont tell.

    chances? slim. can it be done? yes. is he allowed to take it yes. will he? doubt it. how much is it? less then $1K no big deal.

    some 'windfalls' are madated to be turned over and you signed a document about that. taxes arent a 'windfall'.

    again, bottom line - if you are discharged already and hes dismissed himself then he doest care and congrats for you! whooo!

      OK, but what about my case? I filed 8/12, had hearing on 10/12, and trustee decides he needs more time to check my case for assets. He asked for two extensions, and it is up on Feb. 6. I realize he can ask for more time. But there really isn't anything more for him to see. We sent him everything.
      He never asked to see my return and did not mention a refund issue. Last year I paid in about 1,000 in additional taxes. This year, mostly because I held off from making a lot in the last six months because I didn't want to lose it to the trustee (I'm a real estate agent part time and then I have a regular job), I am getting about $1200 back. But it is jointly owned with my husband, who did not file, and of course the trustee wouldn't get it anyway.
      Do I tell my lawyer about my refund? Do I mention it to anyone? I'm having it direct deposited to my bank account.
      I'm a little worried.
      Filed Chapter 7, 8/16/05, 341 10/12/05
      Discharged 2/16/06, Case Closed 3/8/06
      FICA Score (Equifax) as of 10/13/06 - 645

        You mention nothing. Unless you are asked.
