Anyone else have a 6 month delay on their (pre Oct.15) 341 meeting?

    Anyone else have a 6 month delay on their (pre Oct.15) 341 meeting?

    After browsing through some posts, I feel that I might be some sort of selectee. I filed on October 13th, 2005 and my 341 isn't until March 28th of this year. That just seems like a long delay; I do understand that the courts were swamped but I'm suprised at how many post-law change Chap 7's are being processed before mine.

    Anyone else have an experience like mine or are in the same position?

    Will I be treated as a different type of Chap 7 or will the Trustee stomp on top of me because he/she are used to the new laws?

    I wonder if I should wait to file my 2005 tax return until just after the 341.

    Discharged: May 31st, 2006
    Closed: May 31st, 2006

    Is there anything unusual about your case? A six month wait sounds odd but I'm no expert.

      Debtjumper,

      You need to check with the clerk of courts and make sure they haven't put your discharge date as you 341 date on their paperwork - (they do make mistakes too).....

      The date you give would just about be your discharge date.....

      Let us know what you find out.....

          umm, 6 months is very excessive. no courts were swamped that much i hope! call the court clerk and question this. too bad you waited so long to ask. its usually 30 days to 60 days. not 6 months!

          if you filed under the old laws (which you did) then you stasy under the old laws.

          i would file my taxes now and try to spend it on needed things making it harder for the trustee to beg for the money back. keep reciepts adn make the items for a good cause. insurance, care repairs, whole life insurance (which can be cashed out again later if you wish), etc.
          Im not an attorney or a trustee. You cant trust me either though!

            I filed 10-13 too. I didn't have my 341 until 1-13-2006. 92 days. And pacer still just shows--"awaiting 341" even though trustee filed initial report and has filed notice of assets(tax refund) on 1-23-2006.
            I would do as recommended and check with the clerk and make sure the date is correct. Ask you attorney too if you have one.

              PACER:

              "First Meeting of Creditors with 341(a) meeting to be held on 03/28/2006 at Meeting Room, 200 E. Liberty, Ann Arbor 341. Objections for Discharge due by 05/27/2006."

              I'm gonna call today......I don't have an attorney either

                Well michigan has had one of the most extreme downturns in terms of economy in the past 5 years. Trust me, I lived there, and couldn't find a job between 01-04 after 10 years of steady employment. I had to move out of state just to earn enough money to file. So it does not surprise me one bit if they are up to their eyeballs in filings.

                  I was lucky to get a new job about a month after filing; I consider it pretty stable income too. I wonder what impact this has on the filing of my bk. Currently I make enough money to sustain life on an ok to decent basis (I'm single, no dependants). Any advice besides wearing my rags to the 341? I don't want to come off as "working the system" but I was in real bad shape before filing my bk; I currently consider myself "ok" right now since I don't have the burden of paying over a thousand dollars a month to pay bills.
