Filing today, totally not prepared at all. Talked to my attorney yesterday and he said we should file today (based on my contract going into effect tomorrow).

I emailed him our pay info yesterday and haven't heard back from him. I'm filing bankruptcy today and have no idea what's going on!

Doomed, one of the hardest things for me is to do is to completely trust our bk atty. I just have to tell myself (several times a day), "It's his profession" "He is not going to drop us on our heads and leave us bleeding." "We are going to be OK."

Thanks cb, I'm trying. I'm just worried we're walking into the lions den because my attorney hasn't been doing much prep for us . . we haven't given him any documents but the pay stuff I gave him yesterday . .

doomed, it's ok. Hopefully you shopped around and hired an attorney you are comfortable with. Remember, he/she does this for a living. You are also not his only client. Please try to relax.

Given your last post, you attorney might be doing a skeleton filing due to the tight timeline. This is a basic filing onl of the guts of the bk, not complete. It allows for filing date and then a couple extra weeks to get all the paperwork in. Check with them to see if this is right, should put your mind at ease.

thanks joe I've only heard from him twice today, once to ask for our ssn's and bdays, and the 2nd time because he didn't think they'd accept what we gave for paystubs. I really don't have them, but was able to get my DH's accounting guy to print up a paper with a run down from 6 months to present. Still sitting here nervously waiting.

Take a deep breath, sounds like he's working on it. If you continue to experience confidence problems with him, don't be afraid to address it.

He wants his fee tonite too. Is that normal? What if we get dismissed or something goes wrong?

Filing CH7 most attorneys want their fee prior to or concurrently with filing. Reason being that once you file, you are not allowed to have creditors. Owing your attorney fee would make your attorney a creditor. I do know some that allow for payment plans prior to discharge, but most want fee up front.

thanks, joe. I'm working on our personal property inventory sheet today. Does anyone know if the trustee looks at bank statements AFTER the filing date? Or are we good to start spending again? And not in a way to accumulate debt, I mean I have to get my books for school and lunch...

They look at the bank statement that includes your filing date, so they will want your August statement and your paystubs for August.
