The 'automated system' excuse does not hold up in court. idainc has it right, judges are pretty generous to the debtor. You get damages and legal fees, I am not sure why you don't see more lawyers going after stay violations....saw a website from a lawyer who does nothing but stay violations, he said he couldn't convince other lawyers to go into this area.

Yes, I saw that site too. I won an automatic stay violation hearing AND the same creditor went after me for the SAME debt after discharge. The court tell's me I'll get the same judge too. As far as damages, I'm self employed and I filed pro se so my basis is my hourly rate. And I filed joint with my wife who is also in the business. This time around I added a significant dollar amount for emotional damages as I'm fed up.
