60 Days question

    60 Days question

    My sixtieth day (last day to object) will be on Feb. 11th, which is a Saturday. Would they wait until Saturday to object or am I in the clear so far? I got a letter from the Trustee the day after my 341 saying it was a no asset case.

      If the trustee says "no asset" then your discharge should come thru immediately after the 60 waiting period from the 341 meeting.

      I don't think you have anything to worry about...

        66 days and still no discharge

        Not necessarily. I have no assets and it's been 66 days.

          Some courts take more time than others. If it gets to be 1-2 weeks after your 60 days, call the BK court and ask the clerk to look into it.
          Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

            Check with the clerk of Courts, your probably discharged and its just not recorded yet..... Clerk will know.....

              I just dug up the letter from the trustee from the 341. This is what it says:

              "341 Held and trustee's report of no distribution: Trustee has received no property nor paid any money on account of the state except exempt property, and diligent inquiry having been made, trustee states that there is no nonexempt property available for distribution to creditors. Pursuant to FRBP 5009 trustee certifies that the estate is fully administered and requests that the report to approved and the trustee discharged from any furthur duties."

              My 341 was held on 12/13/2005. Is it 60 days from the 341 before it gets discharged or it is longer if the 60th day falls on a Saturday. I'm thinking it should've been discharged on the 2/10/2006, right, or is it the 2/11/2006? Also should I worry about any kind of last minute objections basing the letter above?

                My 341 was on the same day...great question...but in my case: BOOM!
