    order granting relief from stay on my house

    I was discharged Jan. 6.

    I was over 30 days once in December on my mortgage. My mortgage motioned for relief of automatic stay and today i found out it was granted. I want to keep my house!!

    My lawyer said not to worry, that they don't want the house, and to keep up with payments. Does this all sound kosher to you guys? I'm a nervous wreck right now. I hope I didn't totally screw things up with one over 30 day late payment.

    Ok, you were discharged on Jan. 6, for a Chapter 7...

    Did you reaffirm your home? Or were you working under premise that you were going to just stay current and not reaffirm the debt?

        Are you current now, or are you still behind? If current now, you should be ok.

          I'm not 30 days late. This month will be about 20 days late. I'm really trying to get caught up.

            They may filed for relief thinking you were going to stop paying altogether. If you call, you may be able to work something out about the extra payment.

              Doesn't make sense why they would have to file for relief if the case was discharged...

              It sounds like they jumped the gun (which they will probably always do, now that you aren't personally liable for the debt any longer) on starting a foreclosure on the property because you were late.

              It still makes me wonder why they filed for relief...

                I thought they filed for relief before the discharge was granted? The motion would have had no meaning once discharge hit though.

                  Your right staci, I see that now, but I wonder why they granted it... assuming it was granted after the discharge since they just found out about it today...

                  Keep it current, by not reaffirming it you stand on dangerous ground anytime it is pastdue!

                    Actually, I believe that the motion to relief of stay hit ONE day before my official discharge. Bummer. But I am trying to stay current now.
