    sooo not my day

    Second post for today ...

    We have a VW Jetta we are supposed to be surrendering ... we hadn't driven it in a while and come to find out, it wouldn't start. We have recently moved and left the car at our old apartment. We knew it wouldn't be there long and we didn't have the $$ to tow it ... we thought it would be fine. We went to check on the car and well ... it had been towed away. OK fine ... the towing company then auctioned it off. What? Now the finance company is calling and wanting to set up a meeting to turn over the car. Our attourney says they couldn't auction it off without the financial company knowing about it. Now what? Our attourney is not being too helpful ... are we responsible for the car? What do we do?

    Play dumb. Tell them it was towed away because it wouldn't start and you had to leave it at the old apartment, and then they told you it had been auctioned off. The truth is, you are not responsible for the vehicle, It belongs to the finance company. Since you are going through BK they can't touch you for the balance. So relax and chill. It is no longer your problem.

      I agree with pinktiger. My friend had a car she was surrendering. She got nervous because the company had not come by and picked it up so she called her lawyer and he called them. They came the next day to get it. She was worried someone would steal it and they would hold her accountable. Short of her driving the car to them I dont know how they could have made her liable had it been stolen.
