    341 done again and tax refund in Oklahoma

    Okay second 341 done today. Of course only question I had to answer was my name. Are the new creditors listed mine. Took about 40 seconds. Somehow the bankruptcy court had attached someone else's creditors to my bankruptcy, so now my 01/16/06 discharge will be around 04/23/2006 (yuck).

    In Oklahoma, the trustee stated they to everyone, that they want all returns (the whole thing, all credits included). My attorney asked me if I had filed yet and I said no, still getting deductions together, as I am a 1099 self-employed person. Of course I told him I will get a refund, but it will be earned income as I am Head of Household with 2 kiddos.

    Not sure this is the right thing to do, but my attorney told me today leaving the courthouse, to file an extension in March or April. He said that they close the cases quickly here in Oklahoma, usually 30 days after discharge. He said to then file my taxes after the closing and refund will not have to be given up. Not sure how all that works, but that is what he says.

          If you're due a refund, you don't have to file an extension. The tax deadline is for if you owe. You can file a refund within 3 years.

          I'm concerned with your attorney's advice... If the trustee said he needs to see everyone's return, they can hold your case open (wouldn't affect the discharge) until they get it.
          Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

            I agree Staci...seems like he would know that extensions are primarily for people who owe the IRS...when you think about it why would anyone file an extension if they knew they were getting money back? Obviously there are exceptions like too much paperwork..too little time, but I guess I am the paranoid type because the trustee is the consummate 500 lb gorilla and I would be afraid to jeopardize my case as in having it dismissed. Of course he is the legal beagle...Still I would get another opinion from another lawyer, paralegal, court, etc. Do not take any chances in having your case dismissed.
