    Not another 341 report?!

    Well, some folks may tire of of seeing everyone's descriptions of their 341 creditors meeting, but I know I received great peace of mind about mine by reading about everyone else's, so I thought I'd add my two cent's worth:

    If I can offer any advice from my experience, it's to BE PREPARED and BRING A BOOK. I filed on 1/24 and my meeting was yesterday, 2/22 at 4pm. I showed up to meet my lawyer at about 3:30, and saw on the docket schedule that I was the next to last filer on the schedule for the day. When I walked into the meeting room, I knew I was in trouble. There were at least 30 people sitting in there watching the proceedings and waiting their turn. The trustee was running VERY behind schedule, due in large part to the lack of preparation on the part of the filers and their attorneys. The vast majority of people had filed through an attorney, and almost every one of them was still missing some documentation, in most cases either the means test, their schedules I or J, or their pay stubs. The trustee was extremely forgiving, and only continued two cases in which so much documentation was missing that he couldn't proceed. In most cases though, he kept going, which resulted in a ton of delays as he and the attorney shuffled through their papers to find what they needed. And in EVERY case, he had to ask for a copy of the filer's 2005 tax return.

    By the time he got to me, it was 7pm, and I had been there over 3 hours! Thanks to a great attorney AND the information all the great folks here have shared, I was the ONLY person to provide everything the trustee needed prior to the meeting, for which he was very grateful. As a result, my turn lasted all of 5 minutes, and consisted mostly of routine questions like my name, length of residence in my state, confirmation that I had completed the BK counseling, did I read and sign my petition, etc...

    Most of the attorneys blamed electronic filing for the absence of the documentation that the trustee needed, but I filed electronically, and it was all there, so whether you file pro se or through an attorney, make sure everything is in order, and make sure to bring copies of everything just in case. And if you've already filed, be sure to send a copy of your tax return to the trustee BEFORE your 341. Unless you have a complicated case, if you do these few things, you will be absolutely fine!

    Thanks again to everyone who had previously shared their 341 experiences. It eliminated most of my fears and apprehensions, and made mine a relaxing, if tedious, experience!

    Never feel that way. The 341's are the best here. It gives us all a chance to know what to expect. It's great that you are prepared. Hopefully you get a discharge real soon! At least I hope your 60 days fly's by real fast!

    As for the delays I'm almost glad that the new laws are tougher with the paperwork. This is such an important issue and there are those that still go unprepared. I can understand there are circumstances beyond ones control, but I still find there is no excuse for most people that they can't have everthing ready at their disposal for the trustee to make this difficult time quick & painless.

      Absolutely...we want people to share their experiences..dont worry that we have read a lot of the same thing. We are interested and always ready to help with suggestions and offer support. That is what we are all here for..helping each other get through the process...glad yours went okay and sorry you had to wait so long. Ours went quickly and smoothly thank goodness. Good luck..

        I'm with you. Today I had my 341. while my attorney told me not to worry about bringing anything (beside driver's license and s.s. card) I still felt as if i should. So, i did. ..luckily...clearly the trustee was disturbed with my attorney's negligence (he had 6 cases) I feel as if I was strong with my documentation to back up everything. Especially an extra copy of last years profit/loss statement. we'll see though, i can't help but wonder if getting a better attorneywould have not put out so many red flags.

          Always love hearing the 341 stories..thanks for sharing yours.

          I don't think I will need to bring a book though. I am easily entertained by people looking for stuff..long as it's not me.

            Always good to hear experiences. I know they helped me through mine.

            Our lawyer suggested bringing a book to mine. I didn't though I was interested in hearing the cases, which helped me realize how well prepared this place had made me, and how well prepared my lawyer was compared to some. Some of the cases you just shook your head at the things missing....
            May 31st, 2007: Petition Filed by my lawyer
            July 2nd, 2007: 341 Meeting Held
            September 4th, 2007: Discharged and Closed.

              I love them too! I wish we had a section just for the 341 stories. I read most of them now, but I know after I filed I will be back and I will LOOK for them to read them again, to prepare even more.

                i just had mine today. my attorney didn't say one word to the trustee the whole time i was up there. so i guess the only use he's worth is putting together all the paperwork. if it wasn't for that, i could have done this myself.

                  There is really nothing to "prepare for" as far as the 341 goes, as long as your petition was filled out correctly and all documents submitted per the Trustee's requests.

                  I did take extra stuff "just in case": my car loan papers, copies of my taxes for the past 3 years (just in case), copies of credit reports, etc. etc... But none of it was needed, and even if they do need something it can be submitted afterward. About the only thing it is absolutely necessary to take is your social security card and ID.
