    AAaaaaaaand......I'm filed!

    Got filed and got the case number today. No assets, retain n pay on the mortgage, exempting the car (she's old and cosigned). Not sure what's the 341 date will be just yet....lawyer says look for something in the mail early/mid next week giving me a date n time (his office will call and confirm when they get it as well). He thinks it will be in the first week of the new year at this point.

    We have not exempted my tax refund for next year (because we don't know what it is, as it has not been consistent from year to year), but my lawyer says not to worry about it because my full wild card exemption is still fully open (6K in MD), and the refund is generally 5-6K for the past 2 years, so the trustee likely won't hold my case over, because we can just amend to exempt it if he/she tried.

    I've never been much of a religious person, but I am praying on everything holy that I can get through this as smoothly and as quickly as possible. I've lived on a healthy diet of Xanax and cigarettes for the past month, so I am glad to have the stress knocked down a few notches today.

    AMEX called this evening (of course they've been calling about 4X per day since i went late about 2 weeks ago)...I informed them of my filing...they asked for my attorney's name/firm and the case number, and said they would update my file accordingly (the lady on the phone was super nice about it, surprisingly). Otherwise, the phone has finally been silent.....it's a wonderful sound

      Congrats on filing, BK. Isn't that a great feeling to finally be able to say, "Here's the case number" and know that's the last call you should receive from that creditor? Here's to smooth sailing the rest of the way!

        I am so happy for you BKlooker!! I bet that felt GREAT telling AmEx!!

        My cigarette consumption has been out of control the last few weeks - no xanax here - but my doc gave me some ativan today - I feel better having taken just one! I can not wait until after December 10th so we can file!!

          Thanks [email protected] i have a history of anxiety problems, I have been on a number of meds over the past couple years. Zoloft worked well for a short time, but the side effects got to be way to much to handle after a few weeks; never could sleep more then 2-3 hours straight without waking, felt 'wired/awake' all the time but not anxious, and totally nuked my drive to spend some 'quality time' with my man-friend, if you get my drift. Got switched to Alexa and that was a BIG mistake because it made me a high-strung nervous, shaking mess for 3 straight days til my doctor told me to stop taking it.

          She has me back on Xanax temporarily after telling her all I am going through (I am finish up school this semester as well, plus i work full time) since it doesn't have all the side effects. She has referred me to a therapist/psychotherapist group, as that way i can be tested for clinical/mental/genetic anxiety disorders like bipolar or dysthymia and can then prescribe medication and monitor accordingly, but of course it takes a 6 weeks before i can get seen by specialists.

          I am glad to be filed, and yes it did feel good telling AMEX to go climb a tree. The lady on the phone said "you realize the card will be cancelled, correct?", and I giggled and said of course

          I am still nervous about my case in general since I am just barely coming in on the means test as passing. But my lawyer says since I am passing just using the basic Fed exemption limits, there is no need to add in all my 'extras' just yet because there is nothing about my filing outside of the limits...adding the extras just to lower the DMI would automatically raise a bunch of questions, so it's better to wait and then we can amend later if it's an issue (I have documented medical expenses way over the exemption limit, amongst other things).

          In addition, I have no assets whatsoever...no IRAs or Bonds or anything like that...just $70 in my savings account, $300 in my checking account, my 8 year old (paid off, cosigned) car worth like 5K, and that's it (house is upside down by a solid 20%). I don't even own any jewelry other than the 3 pairs of faux-pearls i got at Claires 2 years ago that i wear interchangably and the wrist watch i got at walmart for $11 last year....oh any my nose ring. My lawyer says that the lack of assets also works well in my favor.

          Time will tell....i'm curious as to when my hearing date is....I found out that the meeting location is like 4 blocks away from my job, so no worries on getting there or finding it, whenever it happens to be.

          My lawyer has been at this a long time and has been really great so far, and his firm has been so very nice and prompt/responsive overall, so i am going to just trust in that, as that's about all that's left to do at this point.
