    A Couple Questions: Missing/Need to Correct Paperwork

    Hello All

    I am new here and filed pro se on 11.12.2010 - I received a missing documents notice about a week later that I was missing Statistical Summary of Certain Liablilites and Summary of Schedules with a filing deadline of 11.29.10. Got them filed 11.22.2010 when I turned in my mailing matrix.

    On 11.22.2010 I pick up the pack of free forms (just for review purposes) and realized I did not submit a Statement of Financial Affairs. It was not check on the missing documents notice, I must have missed it on my checklist. How important is that form? Could this cause a problem at my 341 meeting? Should I submit it ASAP?

    I did forget to include some smaller creditors on my Schedule F and need to correct my Schedule G - I didn't include my rent lease by mistake. My 341 is scheduled for 12.22.2010 (yeah Merry Christmas to me) should I amend my schedules before the meeting or wait till after in case I need to make more corrections?

    I just don't really want to be wasting time, money for parking and gas if I can do my 341, make my payment and submit my corrections all on one visit on the 22nd.

    Hi desdemonab,

    Leaving out the Statement of Financial Affairs is a pretty serious error, get everything fixed ASAP, you don't want to go into the 341 with sloppy paperwork and a bunch of errors. Apparently trustees get p***** off at pro-se filers (and attorneys) who weren't prepared and don't have everything correct and ready to go.

    You can't pay filing fees, amend forms, or file documents at the 341 meeting. All that has to be done through the clerk of the court, not the trustee.

    Also, since you are pro-se, have you checked the BK court for the Local Bankruptcy Rules? Courts may have their own version of forms they want you to use, some cover sheets they want over some forms, that sort of thing.

    Can we assume you have the NOLO book?

    Maybe you can show up at your Christmas 341 in a santa suit...

      Thanks for advise - I will get the Statement of Financial Affairs done tonight and take it by the court on my lunch hour on Friday.

      I do have all my local forms - as they are downloadable via the MI website and are present on the checklist. I am just surprised I missed the SoFA worksheets, and it wasn't checked on my missing document form - good thing I decised to double the free forms.

      What I meant on the pay my fees and submit my amend forms at the 341 meetings is that the Trustee's office and filing offices are in the same building here one one the 13th floor the other on the 17th. So the plan was to attend the 341 in the AM then go up 4 floors pay my second payment, and submit my amended forms all on the same day. Sorry I didn't make myself clear.

      I would have to leave off the jingle bells on the suit or I would never get through the metal detectors.

        Can someone tell me - do all the courts send a notice if you've missed something? I filed pro se on 11-18; if I did not include some necessary form, would I have been notified???

          You may want to advise your landlord you are filing...mine was notified even though I did not list him as a creditor, nor include him in my mailing matrix. He was pretty understanding, but I was embarrassed - I did not feel this was something he needed to know.

            Hi

            In Eastern Court of Michigan I did receive a noticed that I was missing paperwork, it was mailed to me about two days after I filed - I filed on 11.12.2010 and it gave me the due dates when the missing paperwork was due into the office. Not sure if every state does that.

              I know - I am not looking forward to that call. We have a pretty good relationship, I never have been late on the rent and I only call if something big breaks or we have an emergency - like when the garage door spring snapped and the door when crashing to the floor. So I am his dream renter, lets hope this doesn't sour him.
