    Greetings all, it's my first post. got some q's



    thanks for all the help. i love this internet thing. so much help out there... i have been lurking here for a couple of weeks. am filing my pro se docs on monday morning. i completed online counciling yesterday and i believe all of my forms are in good order. i just need to do the copies required and drop them off at the court.

    question: when i drop off the ch. seven petition and all attachments, do i get my case number on the same day and do they stamp my copy as received.

    Should i just go ahead and provide copies of my tax return for last year with the filing or wait for the trustee to request?

    what font size should my matrix be. i am thinking 12. any advice?

    this was a pretty interesting process, i have been a paralegal for over twenty years, so i basically can handle this, but i gotta tell you, mine is a no asset case and selecting the federal exemptions was a no brainer, but if i had anything of value, i wouldn't have filed pro se without a lot more study. too complex and too easy to make a mistake. I am filing a waiver of the filing fee, so let's see what happens.

    What state are you from? I plan to file pro-se myself in the next month or two. I have been studying and learning what I need to know about bk. Regardless of whether or not you have legal representation you as a paralegal know that you should be fully aware and involved in what you are getting yourself into and not being totally blind. What company did you use for your counseling online? How much did you pay? Did you use software to type up your petition? I don't know what font to use for the matrix, but from what I understand the day you file you are given a case number and the "automatic stay" will also kick in. So that's good just in case you have a creditor harrassing you - you can give them your BK case # and tell them to "keep it moving!" I would hold off and wait until you have your 341. Bring all your paperwork with you to that meeting. The trustee might ask for more than last years return but you will at least be prepared. IMHO only file the necessary papers that go with the petition and wait to the 341 to show the rest.

      You might actually submit your docs to the Court in advance of the 341 about a week or so, and take 2 copies of everything to the 341 Meeting with you. That way you have an extra set to hand in if the set you submitted in advance get's mislaid or misfiled.

      Your BK petition can be dismissed if the necessary docs are not received either prior to or during the 341.

      I read somewhere where the Court likes to have the Creditor Matrix submitted on disk. I would think that would mean on a floppy disk, but not really sure. If you do go that route, you might use a common program like Word, and submit not only the disk, but hard copy as well, just in case. Font size,......... Just a guess, but I'd say 12. Most every prof or teacher for my kids always says 12. Times New Roman style font is what I'd suggest as well.

      Maybe a Pro Se Vet will chime in with sage words of wisdom from experience.

        i am from massachusetts. i had a hard time finding free forms on line that were fillable but finally found them at new york bankruptsy court web site. type fillable bankruptcy forms in your browser. these are just the forms, they do not allow you to save your changes...that's what you get for free.

          You can call your court to see if they have preference for your matrix whether it be disk or print. Mine was print and using bk software it came out the same size as the standard typeset you would see from the old school typewriters, so 12 sounds right. When you submit your filing, they can stamp it on the spot. They may or may not immediately issue you a case number, but if not you can get it within a day or two.

          AND I would not provide any tax returns until asked for, which most trustees will by your 341.
