    If you owe back taxes, are in a chapter 7, does the IRS still take your refund?

    For the first time in many, many, many years- we are getting a refund! It's only $500, but still! Just wondering if because we are in a bankruptcy if the IRS will still absorb it, or if we will actually get it back?
    Ch 13 filed 06/22/09. Dismissed,thankfully, 03/31/10. Ch 7 filed 06/28/10. 341 07/29/10. UST POA 08/06/10. UST mot to dismiss hearing extended to Dec...Feb...March...May...Aug. UST withdrawal of dismissal filed 05/31! DISCHARGED 07/12/2011!

    Hi olivies,

    From posts I have seen, the IRS is pretty good about bankruptcies, ceasing all collection activity during the case and not trying to collect on discharged taxes.

    If you have non-discharged taxes, they should have an offset to collect it out of your refund.

    Hope you discharged them all and get your refund! Small victory for all you have been through!
