Trustee wants to sell my house

    The attorney that you hired that "dropped the ball" needs a complaint filed against him with the state board.........
    Also he needs to refund your money except for the filing fee..............
    Don't let him get away with doing nothing and making money off you!!!
    Demand a refund since you had to hire another attorney......

      We never got that far with him Minny.

      When we got the threatening letter from the Lender about the Mortgage, he was the most reasonable attny we'd seen. Hubby and I decided we'd just go for a DIL on the house and be done with it. We also decided to let this attny handle it.

      So I called him up and asked if he could handle a DIL for us on the house. He said, Sure he could do that. Bring him the letter and $350 and he'd take care of it. He did call our Realtor and had her fax him copies of our contract, the contingent offer, and current Title work on our Deed. That's all he did. He bills $225/hour, so he could easily say he did at least one hour of work on our "case". He could even possibly justify the whole $350. It's just not worth the hassle.

      I voiced the same thoughts to our current attny and he said, "Yep!" He agreed we probably couldn't get any money back out of that attny. Then our attny said, if clients aren't satisfied with him or comfortable with him, he just refunds their retainer. No questions asked.

        Whether I got any money back or not - I would still file a complaint against him since you had to hire another attorney.

        Let "him" EXPLAIN his actions to the Attorney General - LOVE IT.........

        Remember - EVERYBODY HAS A BOSS!!!!

        You might even get a "good faith" check back in the mail from the ole attorney..... compliments of the Attorney General....

          Thanks for your prayers, but.

          Dismissal Denied, Judge said that selling the house for less than it's worth was not grounds for dismissal and that if I thought it was worth more then I should find a buyer and pocket whatever might be left over.

          I found a lender that said he could pay off all my claims which total about 51,000 and then the trustee would not be able to touch anything if there is no debt and my mortgage is current. He will charge 14% plus closing costs. but it will still be cheaper than letting the trustee sell the house. Then after a good payment history of about 6 months to a year, another lender can get me 6.25% on both 1st and 2nd mortgages.
