    Means test question

    I am meeting with a few attorney's next week to discuss filing chapter 7. We should pass the means test with our mortgage that we are current on and our new car loan. But I would prefer to just be under the median income and not have to worry about it.

    We have 3 people in our household and that puts my husband's income over the median, but I am 9 weeks pregnant with twins. Even if I was pregnant with 1, a family of 4 puts us over the median. Are you able to include unborn children in your household size?

    I don;t think you can include unborns. If you really want to be under median then I think you have to wait till kids are born. But if you pass the means test, and aren't in a Schedule I & J dilemma then why wait? See what the attorneys tell you. Good luck.

      Unborn children don't count for means testing purposes.
      I would suggest you wait until after the twins a re born in case, there are unexpected medical expenses that insurance doesn't cover and then, you can include that in your filing.
