    Car I claimed on my Means Test, can I sell it now?

    I claimed three cars on my means test and I would like to sell one of them or give it back to the bank as I didn't reaffirm.

    When would a safe time be to do this after 341? or after discharge?

    I wouldn't rock the boat. Wait until after the discharge.

        While 98% of the time it MIGHT slip under the radar after the 341, doing so will put you at odds with the Trustee. The Trustee "owns" you during the Ch 7 process, and until discharge you would be selling an asset the Trustee technically owns.

        Like I said - 98% of the time this might go unnoticed...but you really really REALLY don't want to be in the 2% Club. Really. And a third car is just the type of asset that would draw attention for an audit.

        As above - wait until after discharge. No rush. Or, ask the Trustee for permission.
