    What does this mean?

    Hi Everyone:

    I filed my Ch 7 bk(no asset) on 4/18/06 and my 341 hearing is on 5/23/06. I finally looked up my case on pacer and it said for Flags: DebtEd. Does anyone know what this means? I have student loan debt, could this be it?

    Also the trustee mailed me a letter only requesting a copy of my most recent tax return prior to filing and 60 days of pay advices (stubs) prior to filing. Is this a good thing? Should I just cover myself and bring other things?

    Did you the Debt Education course required? The pre bk education...sounds like that is what they are looking for. I had my certificate filed with my petition.

      Pay stubs are normal (required) items for them, if u need to take debt ed, you should have gotten a deficiancy notice when you filed( credit counciling course) , you also need money mgt course pre discharge, if you have those then you must call the clerk and find out what it means, unless of course you have a lawyer, then he or she will know. Sorry but if you filed pro-se they are not going to explain anything so you MUST STAY ON TOP OF EVERY LITTLE THING PERIOD. Good luck.

        It is also possible that if you listed a student loan for discharge, you must understand that usually student loans are NOT dischargeable, maybe always. I am sure someone else can clarify this better. I suppose this would raise a flag, that does not mean the others won't be discharged.

          Pretty sure it means that you have not filed the certificate where you have taken the pre-discharge debtor education.

            Thanks for some of the replies. I already did the pre-bk counseling. I have not done the other course required prior to discharge yet. In NY I have up to 45 days after my 341 to turn in that certificate. My 341 is not until 5/23/06 so its 45 days after this date the certificate must be turned in.

              We gave our attny a stack of stuff. You might want to gather some of the same things and take them with you to the 341. Just in case you get asked for anything.

              The paralegal said our attny wanted all this stuff on file in the event our case gets audited. Our attny's office is set up so they scanned our docs into their system and returned our originals to us.

              *4 years income tax returns with all W-2's, unemployment statements, and any other earnings statements.
              *6 months pay stubs.
              *CC statements from all the Creditors we are filing against.
              *Any form of correspondence from those Creditors. Our attny likes to send a letter of notice to every address he has for every Creditor.
              *A copy of our Mortgage.
              *A copy of the lease agreement on the house we're renting that we live in.
              *3 months bank statements.
              *Last 2 months bank statements for the bank acct we had outa state that we closed when we moved.
              *3 months utilities bills: cable/internet, electric, gas, water softener, cell phone, land line phone.
              *A copy of our life insurance policy statement and the bill for that.
              *A copy of Hubby's one little pension that remains from a company he worked for years ago.
              *Copies of our auto insurance policies and bills for those.
              *Copy of our Renter's insurance and bill for that.
              *Copy of Hubby's cash out statement on the Retirement IRA.
              *The letter of notice of Default and Acceleration on our Mortgage.
              *The letter from the attny notifying us of the date of the Foreclosure sale on our house.
              *Copies of receipts of all property sold in the last year. We traded a vehicle, I sold jewelry, and then we sold my truck to pay our income taxes.
              *Copies of service contracts we have. In our case, that was cell phone. When it expires and a statement of the cancellation fees.

              There may be more docs that we gave them, and if I remember, I'll post them later. All the attnys we were Consulting with were asking to see pretty much the same stuff.

              We don't have Student Loans, alimony, child support, SSI, or many of the other things people might have.

              I'd suggest you get an expandable file folder. Collect all your documents, and take them, with copies of the docs, to your 341. Be prepared to show originals and give copies to the Court for their records. You never know what they'll ask to see, beyond what you've already been told.

              It may be time wasted or it could save you some grief. You just never know what they'll want.
