    waiting for 341 meeting

    I have been thinking and wonder:
    If I have made any mistakes will I know before or after 341 meeting.
    I keep thinking bad thoughts now.
    I am kinda getting scared.

    Here is how it went at my 341 meeting. My attorney went up to the trustee's assistant and she was handed a packet of information. This information had everything the trustee had questions about or concerns about. She showed this to me prior to the meeting. It kinda gave me some prep time on what quesitons they would ask.

    If you file pro-se, I'm not sure if you can get that information or not.

    Some bk districts I understand actually encourage attorney / trustee office conversations prior to the 341 meeting so everything can get "fixed" prior to the meeting.

        When you get to the meeting, go to the front and ask the assistant if there is any information package concerning your case. I don't know if they will give it to you or not. Good luck.

          Or maybe check with the Clerk of the Court and see if you have an info packet. Call maybe a week or so in advance. That might give the Trustee a heads up that you're interested in explaining any questions they may have in advance.

            If it is a cut and dry case, below medium, no assets, your probably not going to have an issue. My attorney seems to feel that right now, the trustees are only interested in the borderline / over med income filers who are in there with a chapter 7. That is in Missouri though, probably depends on the state.

                my 341 is this Tuesday

                I am a simple no asset Ch7 case. I filed pro-se. The only correspondence that I received from the trustee was that he needed copies of my recent federal tax return and 60 days of pay advices (stubs) prior to filing. I sent this by certified mail weeks ago so that I had proof that the trustee's law office received it. The trustee will usually send you a letter requesting additional information for their review weeks prior to the 341. Your case could be dismissed or adjourned if you don't comply. I live in NY so this has been my experience so far.

                No matter how many times that I have read here that the 341 is quick and in most cases cut and dry, I am filled with anticipation and anxiety. I will probably not get a wink of sleep tomorrow night. I don't think a sleeping pill will help. I will probably eat light or skip breakfast Tuesday morning for fear I may not be able to hold it down. My nerves always affect my stomach. I will finally breathe a sigh of relief when its over with but then here comes the waiting out of the 60 days.

                I did my pre-discharge counseling so I will happily file that at the courthouse once the 341 is over - the courthouse is a few blocks away from the trustee's office.

                I am a little bothered by the bank holding my car loan. A couple of weeks ago, I mailed them my re-affirmation agreement. My loan is up to date so I didn't forsee any problems. The agreement came back signed by the bank, but under close examination, the person who signed it forgot to "date it". I figured ok let me just fill in the date myself, but then, I noticed that the person who signed - did not list their title or position at the bank and it would have looked more professional if the agreement beared their official stamp. I did not want to take any chances with the bk court rejecting this agreement due to the bank's omission of info so I mailed it back certified explaining the situation. Now I got the green card back so someone at the bank did get, but so far they are not as prompt to return the agreement to me, so this is building to my anxiety. I wanted to drop off this agreement and counseling certificate with the court all on the same day - and be done with it - JUST WAIT FOR MY DISCHARGE! Well maybe it will be in tomorrow's mail.

                It ain't over to it's over!!

                    I am still here, just been lying low

                    Hi Sinkingfast:

                    I have been so stressed out with my finances and my significant other might be starting a job, but we don't know when. I am stretched beyond recognition. I even cleaned out my coin jar wrapped up the coins and took them to the bank just so that we can make it until I get paid next week and my son gets his SSI. I was debating whether or not to spend the 37.00 to get my car inspected or wait to next week when I got paid, but my sticker expires 5/31 so I got it over with. I prayed during the inspection everything will be ok because I could not afford to have to fix something to pass inspection. Luckily things were ok, the guy did say my oil was dirty and needed changing. Too bad I didn't have an extra $20 to do it. So when I get paid next week I will do the oil change and tune up. Next time I get paid I will do something else. Gas costs so much in NY and I knew my SO had to take our son to his lacrosse tournament in NJ, so I said to him that fill it in NJ, because we only had a 1/4 tank left to get across the GWB. He called me later to say that we didn't save much. Reg gas in NY is 3.29 a gal or more. 2 weeks ago gas was 2.67 in NJ, but its now 2.97 a gal. That's why he said that we didn't save much. These are the times that I wish I had my credit cards to pay for gas and to get an oil change.

                    My twins are graduating from the 8th grade in June which means that I will need to buy my daughter a dress for her dinner/dance and one for graduation and my son who doesn't care what he wears will need something. And lets not forget gifts. My other son who graduates from 8th grade next year will want a little something so that he doesn't feel left out for working hard this year too. I hope that SO starts earning quick to help pay for these extras.

                    I have been visiting the forum, but I kinda of been taking a back seat to the BK for a bit. I have been focusing on stretching my dollars to pay for food, gas, and other necessities after the rent has been paid.

                    Getting through BK is hard. Yes, I filed but you also have to adapt to other behaviors like living without plastic, cutting back and thinking of new ways to stretch what you have when you are not in the position to make more.

                      Special occassions and girls always translates into $$ for dresses it seems. Try some second hand or consignment shops to maybe find your daughter a couple of pretty dresses. I've had luck at those kinds of shops off and on. And sometimes you can even find things for boys as well.

                      Another thought is a good basic solid colored skirt and a couple of different tops. My Best Friend is doing something similar to that for her daughter's wedding. She bought a great suit, but it came with pants. She didn't wanna wear pants to the wedding, so she found a skirt that's and exact match to the trim in the top of the suit. She'll wear the suit top with the skirt to the wedding and then change out to the pants for the reception. That way she can still be dressed up but a bit more comfortable than wearing the skirt.

                        Hey buddy you'll be alright. The trustee seemed to be very cool with me; I was the only one that filed Pro Se. He didn't hassle me at all.

                        I will say that my heart started to POUND in a minute before my name was called. I though that I was going to pass out. That was wierd. I did feel a million times better though once he started to talk and wasn't a jerk.

                        I wore what I could find that morning - old polo shirt with a couple of those "permo" italian dressing stains and some old old OLD olive colored cargo pants. Not to mention my old work boots. I looked like a homeless man. Funny thing is that I wear that same "wardrobe" when I work on crap outside or on my car.

                          OK, My means test was 503.00 below median--my assets are only 605.00 no money in the bank to be truthful I am in the red. So wouldn't this be a simple no asset case? Also, I live in Kentucky. I am not in a big city so here everyone knows everyones business.
