    Thank you my friends , it has been a hard journey, but we just got the wrong attorney and the wrong trustee.

    Hubby was -1700 on means test , and was not making the house payment. So the Florida trustee decided to attack him because of that. When they could not, they went the totality of circumstance route. (Fortunately we were putting away our money in 401k) The trustee wanted to know in the objection what he was doing with the money since he was not making house payment. We made the hard decision to dismiss since his retirement is soon. The attorney knew that when we went to him. He was heading for retirement himself and needed the money so he took us the chptr 7 route in our opinion. He has since went to work part time for another attorney. We met with him and he said he would of never went the 7 route with the florida trustee now objecting so much.
    He was a chptr 13 clerk in past time. He wanted us to file 13 and wait out the retirement.

    We have 2 family members who were also twice the income, ( had 3 times unsecured debt Hubby had, one had a 36K BOA credit card)
    they slide thru in a chptr 13 with 100.00 monthly pmts. They did have a child to support. But unbelieveable the court allowed them to claim their pet horse 400.00 expenses for boarding. Same trustee , I cannot get that.
