    For those of you I can help under the new BK Laws my wife's case was discharged successfully today. Since her debt was in her name only she filed alone and was able to filed Chap. 7 even though our household income was substantially over the median income of our state. We were able to claim substantial deductions by the use of the "Marital Adjustment" and keep her in Chapter 7.

    We had purposely kept our debts separate and have always kept our cars and major debts individual for this vary reason in case something ever went wrong. For those of you about to get married, never get joint CC accounts and keep vehicle debts separate (your car in your name, spouse's in his/her name).

    I was able to subtract my car (in my name only) and my CC payments (in my name only) from our household income as well as other things to bring her under the median income...

    Anyone that would have questions feel free to ask. We had gone through 2 attorneys before we found one willing to try out my theory (this was my own idea) and it saved us from paying about $875/month in a Chapter 13 plan...

        I'd suggest doing a write up, like a how-to, for this "Marital Adjustment"
        filing your wife did. Make it as detailed as possible, and submit it as a
        "sticky" to the forum Mods. it may be of great value to future filers.

          I will do a write up as soon as I get time to sit down for a while because I really feel like there are many out there of limited means who are truely getting screwed by crumby lawyers who take advantage of the least among us.

          My wife's case is truely one that shows that anyone can find themselves in compromising circumstances financially and after meeting with a couple attorneys it was obvious I'd have to completely educate myself on the process.

            I am having so much trouble getting an attorney to explain "marital adjustment" to me. Despite the language on the forms my first attorney said the marital adjustment is always zero (I live in Indianapolis, IN).
            My wife makes good $$$ and has no debt. I have a alot of debt and make about $20k per year. I will be filing without her.
            Can anyone point me to a reference source to show my new attorney?
