    Dealing with the Trustee

    I'm in the final process of closing my chapter 7 case with the trustee. Lawyer
    has drafted a letter of offer to settle and close the case. During our meeting the trustee said he would accept a discount to settle the case. Anyone had any experience with this type of dealings with a trustee ?

    also known as "lets make a deal"

    now don't get greedy, and let the trustee win a little, go buy your stuff
    back for quarters on the dollar.

        so if we offer 1/4 the total ($10,000 assets/$2500 settlement offer) the trustee would probably agree to those amounts ?

        The real number in question is about $20,000 but $15,000 of that amount would require lots of work on his part.

          Your getting the hang of it, I would like to know what the assets are though. There was somebody who was being hassled over a six year old computer on here somewhere. The computer is worth nothing!! Think about what the trustee has to go through, pick it up, store it, retail it, or I should say wholesale it, pay a commission. This all takes time and money, remember the trustee is getting something like 25% on these dollars he collects as compensation. I forget the dam numbers, someone knows here or posted it, maybe it is like 50% first ten thousand then like $10,000-50,000 like 25%. Just from the sounds of it my spider senses tingle $3,000-$5,000 maybe that is even too generous. Lay it on us, what is the stuff?

              In 1996, I bought my eMachine for $49--think the trustee will want that from me? It's not even a Pentium!

                  At least you have an Trustee that would "work a deal" or allow a buyback........ Mine totally refused, said a creditor said "no dice" - "auction"...........

                  And I had offered to pay fair market value, no questions asked.......

                  They forced an auction anyways.............
