    Sealing BK records....?

    **************** New Question ********************

Sealing BK records? Who has done it? or who has had certain perosnal information records sealed such as Pay Stubs (especially that of spouse who has not been a co filer but whose pay was included)

    Hi professorkev:

Since this is a new question, you needed to start a new thread. Please don't put a new question into a thread that is on a totally different subject. Thank you.

I do not recall seeing anything on PACER that showed the pay stubs or pay advices. The petition is there, and the followup legal proceedings. The pay stubs, etc., that you are talking about, is the paperwork that you submitted to your attorney so that they could do the means test and all the back work in order to prepare your case to file.

You should have gotten these files back after you filed. If you haven't, you need to ask your attorney about this.

Now, if you weren't aware, BK filings are public record, and anyone may view them. It will cause them some trouble; they have to either go to the BK Courthouse and view the files in person. Or, they can sign up for a PACER account. Each of these do cause some trouble and effort to do.

The vast majority of people do not care, and could not be less interested. Others will--those running credit checks, etc. But since your wife did not file BK, her credit should not be impacted. If it is, she will need to contest that with the credit agencies.

It's not going to happen, nor should it. As AC points out, it is public record, and that's a good thing for many reasons.

As to the documentation that you are speaking of, you won't find any of it on pacer. You won't even find a document with complete social security numbers unless you were one of the parties or creditors involved in the case.

Most everything is redacted, and your personal information will not be disclosed.
