    Could there be a problem????

    I checked pacer today about my bk. and there was a thing on there stating that Tidewater Finance had been notified of my bk.
    To start with, Tidewater is a 722 redemption auto finance.
    Since I was letting my truck go back I needed a car to get back and forth to work in. This was not included in the bk because I did not get it until June and my petition was filed in May.
    My question is could this possibly hurt my bk case?
    The trustee ask me if I purchased another car and I told him yes. He ask me if it was financed and I said yes. Then he asked if put any money down and I told him no which i did not.
    Tidewater did know I filed at the time I got my car but still financed me anyway.
    I am really worried that my case may be dismissed because of this. I did not lie to the trustee and Tidewater can show the car was bought after the date of the petition.
    Should I be as worried as I am or could I possibly chill out a bit?

    PLEASE HELP!!!!!!!!!!!!

    If you filed a Chapter 13, it could be an issue, a Chapter 7, wouldn't think so.

        Need Help...did you file pro se or with an attorney? I would contact my attorney and ask.

        Unless you see the words on pacer "Trustee motion to dismiss" or "trustee motion to deny confirmation" you should have no reason to worry. Just a notification to a creditor means little or nothing. Sounds like they added a creditor for you. This may be because the debt is secured but I don't know since in a chapter 7 the bk estate I believe is only what you have on the date and time you file.

          Probably the Court is just sending Tidewater a notification letter that you filed BK.

          While you are in an active BK, you are under protection of the Automatic Stay. Legally, Tidewater cannot bill you. They can, however, send you monthly statements "For Informational Purposes Only."
