    Possible Pay Increase...

We will be starting the filing process next week on chap 7...
the atty asks for 6 months income verification, which i can
understand, but during the BK process, my wife maybe
promoted to get a $30k increase in salary... will this
matter? after all, we will have already provided the 6
months of her current salary, and would have already filed
by the time we hear about her promotion...

    Thanks

30K is a lot of money. That's great news for the wife! If you are filing jointly though or if you, yourself were getting the increase then yes you would have to list under oath any anticipated increase of 10% or more and unless you're making 310k a year, 30k is much more then 10%.

The key is maybe. If it is not a done deal before you file, do not mention it unless asked. Many things can happen to make even an almost sure thing a "no."

the only thing is, its not a done deal, nor is it anticipated, we will not
know until several more weeks if she will get the job or not, we feel
strongly that she will, but you never know. I guess I should at least
tell my atty, he could advise me for sure, even if she gets the job,
she will give 3 weeks notice to current employer, by then the credit
meeting would have already been completed i hope.

I have known a couple of people, one posted on the board a couple months ago, and I know one personally that quit a job to take another one and before they started, were let go. Definately talk to your attorney, but you shouldn't (and can't really) put those kind of increases in now. If it all happens after your 341 there should be no issue at all.

True-dat what everybody else said. If the job and salary come thru, deal with it then - don't mention it, hint at it, or do anything else but pray about it now.

              dscurlock,

I am have been reading many replies and posts you have submitted regarding your planning to file CH7 BK. You are doing the right thing by asking tons of questions. However, I would have to say that it would be adviseable to go with an attorney and not try to go this alone. You have a number of variables that could cause major headaches and problems throughout the bk process. Let a good attorney handle this one for you. There are many here that filed Pro Se and did an excellant job, however you case does not seem to be as simple of one. Just my opinion here and not saying you could nto do it ProSe, just saying that with the pay increase issue, reaffirmations, and the other things you have posted about, it would be wise to let an attorney do ti for you. I know you had posted that the attorney wanted some ungodly fee to file, search around there are attorneys that are less and will do an excellant job and will allow payments. I live in Atlanta and my attorney charged me $1200 and that included everything. Was allowed to make 3 payments of $400 each. I did speak with another attorney and they wanted close to $3k to do it.. I came out pretty good and saved money..
              Thanks,
              GaCreditGuy
