    individual vs joint account question

    We are waiting in confirmation of our ch 13 bankruptcy case. Big possibility it will not be confirmed, therefore dismissed, and we will be open to creditors coming at us at once. We filed a joint bankruptcy petition. Almost all of our debt is indivisual credit cards, either in mine or my husbands name, not joint. We are authorized users on a couple of each others cards.

    Ecast Settlement has over 60% of our unsecured debt combined. If they were to sue, would they sue for the entire joint amount or would they have to sue each of us seperately since they are indivisual accounts? My husband makes the income.. I have none at this time.

    I have no knowledge of Ecast Settlement, but I was always under the impression that you cannot be sued for your husbands debt or the other way around if the accounts are seperate, not jointly held.

    I know creditors that call about my husbands debt won't disclose any info about his debt to me on the phone because I am not a joint owner on his accounts. Well that is all but Discover, but they weren't suppose to.

    Hopefully someone will stop by that has more knowledge on this.
