    Sunday morning call

    I just got a call from Beneficial (whom I've never been a day late with, and am now just about one week past due). I thought creditors couldn't call you on a Sunday morning? Or is it just that they can't once they go to a collection agency? I'm confused.

    The woman told me that it was in my contract that they could contact me on Sundays. I looked and I couldn't find it anywhere. I did get her name, phone number, and employee number. Then I gave her my lawyers number and told her they were not to call me again, that my lawyer would be handling things from now on.

    I cannot believe how fast these calls have started. This is what I dread. I was told by the first attorney I saw (decided not to go with her), that I'd get letters first, then calls. That's not the way it's been. I guess they are getting more aggressive with their tactics.

      FDCPA says from 8am to 9pm.....days of the week are not regulated...and only if they are "third party collectors."

      They call first, but have 5 days to send you a collection letter after first contact.

      It's nice to know who's calling at first as you can monitor the letter arrival times...if your so inclined.

      Beneficial is probably the original creditor, so any violations would be regulated by your state laws. Check them to see if they have violated any collection/consumer laws.

      And don't believe anything a collector tells you. They are notorious liars. If it is not in writing, it does not exist.

        if your gonna file, it wont matter anyway. However, when I was still trying to stay above water, Beneficial was one of my easier creditors to work with.

          Thanks everyone for the info. I've calmed down a bit which has helped. I did receive two more calls from Benificial yesterday (this was after I had given them my Lawyers name and number on Sunday. Grrrrrr!!!!)

          CPO, thanks for the info about the timing of the letter. I didin't know anything about that. You are so right about this being the best place to get info. I have learned so much.

          Wayne-o, I'm hoping I'll have an easier time of it with them too. I am definitely going to file. I just need to return all of the paper work to the attorney, and pay the filing fee.

          I'm so ready to get this over with!
