Do you usually recieve a letter from the court or a summons when you are bieng sued ?

Have had a few cc companies leave the usual it will be escalated by x date, or You need your legal council to contact me about x file case number but havent recieved anything in the mail concrete ie in the mail about there threats.

About to pay my attorney this week, then saw the thread about increases on march 17th for the median but thought hell if I can hold off until aprel even may to file it will just mean 12 14 months between the largest usages Im concerned about.

I just keep hearing Discover is pretty ruthless and to add 2 more months to 5 might seem like a safer bet in the long run.

any thoughts would be greatly appreciated.

If you are planning on filing in the next 3 months, i'd say you are okay...Even if you get served tomorrow.

They will have to serve you, even if you don't respond to the suit...it will be a month before they get a judgement, then it will be another month before they can file for garnishments and such.

If you decide to delay judgement, read http://www.attorney-in-alabama.com/not-pay-debt.html for some excellent ways to delay the judgement... I realize it's long, but it will tell you step-by-step how to delay the judgement. If you follow those steps, you can delay the judgement by a year...I know some people on this board have been going back-and-forth on suits against them by creditors for 2+ years...so it's nothing you need to worry about, if you are willing to spend some time on delaying judgement....

If you are willing to delay judgement, and plan on filing anytime in the next 6 months-1 year, then I imagine you will be just fine.

If at anytime before they can actually get any money you file for BK, then their whole suit goes away...they have to drop the suit the moment you file the BK petition with the BK court.
