    Hi to all im new to this forum and from what i have read it seems i came to the right place. Well here is what happened i got a judgement from a creditor and i did not respond because i wasnt sure if i was going to file bankrupcty. so 6 months later the creditor put a levy on my account and they took everything 10K, i did file the exemption with the sherrif and i did get a new court date and it's next month. my ? is does anyone know if part of the money is exempt. i used the one for wages i believe it said 75% of my wages are exempt up to 30 days, i live in california if anyone can provide any help or info would be greatly appreciated...
    BTW the money is still in possesion of the sherriff

    In order to have a shot, the first thing you would need to do is prove that the money in the account is directly traceable to deposits from your employment income. But, I am not sure if CA allows "seasoning" of the funds.

    Seasoning acts to cut off the time in which you can claim wages that are sitting in your bank account as exempt. Many states hold that once the money has been sitting as cash in your bank account for long enough, the money loses its status as wages, and therefore cannot be claimed as exempt under the wage exemption statute.

      Thanks for the fast reply, as far as proving that indeed that money came from wages. I just got a copy of my bank statement stating that part of that money did come from work. I guess my only concern is how much i can exempt. i have tried to find some info on internet and i cant seem to find it. i used ccp:704.070
