    How to find a pending case record

    Sorry for starting another thread today.
    Being overseas I do not have access to real time info so I rely on internet. I am under bankruptcy preparations but I have a sneaky suspicion that one of the creditors might have already filed a suit against me for judgement. I have no way of knowing if I was served at my previous US address as my relatives are never home during day. My question is, is there an online public database in virginia (fairfax count specifically) where I could check by my name if there is a pending case? Appreciate any speedy answer as I am getting nervous everyday sitting so far.

    Here's what I was able to find...


    Case Information:

    The Fairfax County General District Court has jurisdiction over statutory misdemeanors, violations of local ordinances, traffic infractions, preliminary hearings in felony charges, civil lawsuits where the amount at issue is $15,000 or less, and mental commitment hearings. The court has three divisions: Civil/Small Claims, Criminal and Traffic. A Court Services Unit also serves the court providing supervised release options for defendants pending trial and probation services after conviction.

    General District Court case information is available online for all civil cases and for certain criminal and traffic cases (those that are pending, those that were concluded after January 12, 2001 and those that were concluded prior to January 12, 2001 that had unpaid fines and costs) at the following web site:



    1) Under Case Information click on "General District Courts"
    2) Select Fairfax County General District from drop down and click Begin
    3) Select Traffic, Criminal or Civil and click Continue
    4) You can then search for your case by Name or using the Case Number
    5) When you have finished using the application click the "LOGOFF" button.
    6) You can return to our Fairfax County General District Court homepage by clicking on Virginia Courts
    7) Click on General District Courts
    8) Click on Fairfax County

    Note: Do not use the "Back" button on your browser within this application.
    Discharged November 2008 100 days after filing no-asset Chapter 7. We intended to let a two-year-old vehicle go back to the bank and reaffirm an inexpensive ten-year-old SUV and our home mortgage. In the end we surrendered ALL of our vehicles and reaffirmed NOTHING. We'll "ride through" our mortgage after the court ruled it an undue hardship.

      Thank you keebler for that link and info. I couldn't find any case under my name but it could also be that the one credit card I am worried about is a bit higher than $15000. I searched in General District Courts, Circuit Courts and Supreme courts as well and found nothing. Hopefully there is nothing. The debt collector must file in the county I last lived in when I was in the US right?

        Because I am worried about my DBA (Doing Business As Account) where there are regular electronic deposits from customers which is my source of income. There is always around $3000 in it which I am holding on to for emergencies, taxes and lawyer fee. I am just worried that suddenly someone will get a judgment and clean up my account one fine morning and the a/c will be frozen. Isn't that what they do? That will totally mess me up.

        I have one other checking a/c with about $1000 which I could close I suppose.

        other than that, no house, no car, no tangible assets. Should I be worried?

          Why are you holding onto that money for a lawyer fee instead of just getting a lawyer?

            epiphany, I have been in touch with a lawyer and already paid the retainer fee. It could be a few weeks by the time we get all the paperwork sorted and actually filed. I am just worried about something happening in the meantime.

              If it's only going to be a few weeks, then don't worry about it. It will take them a month or two to get a judgement, then another month or two to get a writ of garnishment for them to seize your bank accounts.

              Check your credit report to make sure that there are no judgements listed, and you should be okay.

              If you searched and nothing came up under your name, then you have PLENTY of time if all you need is a 2-4 weeks.
