    Collection attempts after ch7 discharge

    I just recieved a statement regarding HOA dues, the HOA management group was listed on the bankruptcy and was discharged without dispute. The letter I recieved today is from a different or new HOA management Co.

    The condo we purchased in Colorado has had many different management companies in the last 5 years.

    Does anyone have a "letter template" they have used to respond to the "after discharge collector".

    I have wrote my own letter and would like opinions on it.

    Reply concerning your attempt to collect a debt regarding past due HOA fees account # Txxxxny-T011xx-B.Hxxx. The HOA dues in question were included in our Chapter 7 Bankruptcy case # 07-21xxxx-EEB filed 10/03/2007 which included Monxxxx at Tuxxxxx HOA attn: Dexxx Nimxxx. The bankruptcy was discharged on 02/04/2008.
    Therefore making this attempt to collect a discharged debt a violation of Fair Debt Collection Practices ACT.

    Strike a reference to the FDCPA. This act does not apply to the orginal creditor or in this case, the management group.
    Instead, inform them they've violated the permanent injunction related to attempting to collect debts discharged in bk.
