    Was served-have a ?

    I received a summons today. It has my name as the plaintiff, and under my address it has POE: xxxxxxx (which is my husband's place of business).

    Why would his employer be listed. He is not and never has been listed on the account.

    Do you work? Possibly there was a mix up as to who your employer is.

      POE, what does that mean?

        Why are you listed as the plantiff? Or did you mean defendant?

            Sorry, I am the defendent. I have not worked in almost 7 years, but the POE is my husband's employer. As I said, he was never on the account, although his salary paid the bill until I couldn't any longer. They can't go after his wages, can they? (I'm in Tennessee).

            I really don't know why they bothered to go to this trouble. I had already given them by bankruptcy attorney info and I'll be filed this week.

              Did you file by yourself? If so, this is where it could get sticky. See an attorney in your state to find out whether or not your spouse is liable for any of the debt.

              Hopefully someone with expertise on this subject will chime in.

                TN is not a communal property state so as long as your husband was not a co signer for the card their is nothing they can do. Just take the served papers to the lawyer when you go to sign them. They can then add it to the paperwork.
                May 31st, 2007: Petition Filed by my lawyer
                July 2nd, 2007: 341 Meeting Held
                September 4th, 2007: Discharged and Closed.
