    Can creditor withdrawl my overdraft protection?

    I have overdraft protection of 1,000 on my checking account. Can a creditor overdraw my account to try to collect money and use up the $1,000 credit limit? I pretty much have all my bills automaticlly withdrawn from my checking account. I would like to keep it open when I do a chapter 7 down the road. Any thoughts on what might happen?

    I would say yes. The overdraft protection kicks in if your account is overdrawn, and if they continue to withdraw payments that causes you an overdraft situation, then the bank would use your overdraft protection funds to pay these bills.

    You might want to close your overdraft protection. Or, to stop payments from your checking account.

    Of course, you overdraft protection could be included in a bankruptcy filing, but where it could potentially have been used in the sixty (ninety) days prior to filing, it could cause a problem.
