    Receved Summons

    I receved 3 summons for the same account from Chase by regular mail (NY). The forms themselves are dated May 6 but one is stamped May 18.

    But the first one is postmarked June 17, the 2nd one (apparently from the courthouse) June 19, and the last one July 14.

    All the notices say I have 30 days to reply to the clerk after "proof of service is filled with the clerk of this court."

    I'm saving up to file a ch 7. I guess I want to reply per se and delay. Does anyone know:

    1. What is my deadline to reply?
    2. How long until Chase can get a judgement?
    3. How do I dealy this?
    4. Can I call the Clerk to reply or do I have to go in person?

    Hmmm, I'm not familiar with NY statutes. However, I would immediately check with your courthouses and look for any actions filed against you. Perhaps NY allows for service by regular mail. If so, then the June 17th date may prevail as date of service by mail. If such is the case, and you failed to respond within 30 days, your time to provide an answer may have expired. Again, I don't know your state laws (rules of civil procedure) regarding date of service.

    In my state (Oregon) if one is served by mail, the service has to be by return receipt. Once I sign for the mail, the time to respond to an initial action is back-dated to the time the service was mailed.

    If your letter has a court civil case number, then you can give the number to your court clerk and ask for any relevant information,
