    went to court

some background. I quit paying cc's 22 mths. ago. I have never spoke to any OC or JDB but I have sent out DV letters. Well one JDB tried to sue in april , I answered the complaint, my reason debt validation. I never heard boo from them or their lawyer after that. 5months later -- I just got out of court , the judge says and I quote " the defendant requested DV and I really don't know what debt validation is, but has he received what he requested? Well the local lawyer that the JDB hired says " the JDB has been unable to verify and we ask for an adjornment as far in the future as possible to obtain the info". The judge gave them till Jan. to obtain info. WTF--- if I had not fought them and been there , the judge would have slammed the gavel for a judgement on me ,but he gives them another 4 mths. to prove their case. They have had 5mths. now they get another 4mths ????? I wrote this so that people remember one thing---FIGHT BACK DON'T GIVE UP. JDB's are scum and I hope they pay lots of money to fight this case and end up with nothing---- I am judgementproof----HEE HEE oldman

Judgement proof can be a real good location to be in. I'm getting close to that myself. That can give you a new perspective on life.

I'm pretty much judgment proof myself. You'd think they'd realize that there is no way to get money from you and so just let it go instead of wasting their resources.

No, you are wrong. Not "Judgment proof" as you will get a Judgment. Collection proof is what you mean. However, if the Judgment is not set aside be bk and is allowed to stand, can haunt you for a very long time. It is very wise to respond. Judgments can be real pains in your future. 'Hub
If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

I never considered myself judgement proof even when I technically was, because I like the convenience of a bank account. Living without a bank account is just too inconvenient for me. The stress of trying to hide a bank account from JDB's was not something that I wanted to deal with while going back to school, which is why I filed for bankruptcy, even though technically I am pretty judgement proof at this point.
You can't take a picture of this. It's already gone. ~~Nate, Six Feet Under

Thanks ACH. Collection Proof is the correct wording, not judgement proof. I am close to collection proof, and have not filed yet, so any judgements are really of no concern at this time. I sure would not want any judgements AFTER bk however.

            Thanks.

I have never seen stone bleed. They cannot get what you do not have. When filing bk, get that judgment cleansed. Now that is what I would call VICTORY. 'Hub

I would really love to know what they paid for these bad debts that they will get not even $.50 in return, and to know that there are already judgements and to pile on --- I feel the pain

bigboy or anybody that knows--how do you go about trying to get the $1000 violation. Do you sue or file a complaint with some agency? Point me in the right direction and I will go after them like a pitbull. I am in new york state if it makes a difference. thanks

It is a counterclaim that you file with your answer....if you have already filed your answer, I think you can do whats called an "amendment" to the answer. Im not a lawyer, so this is not legal advice, just for conversational purposes.

This JDB sued me in april. I answered the court, so the court adjourned the case till this week. When I went to court this week I found out they did not have proof of DV. so I actually answered the suit in april. so my ? is where do I sue them, in my town where they sued me? oldman
