Has anyone had any experience with Discover? I've read that they are fast to sue?

I defaulted on my credit cards in December 2008. In December 2009 I was served by Discover. They are the only ones to sue me so far, though I owe them very little in comparison to my other creditors.
I have a pre-trial conference in early February. I haven't decided whether to file BK or let them get a judgment, as I have some health issues that aren't resolved yet.
Supposedly Discover is the most sue-happy of credit cards. Good luck to you.

I made my last payment to Discover in Jul 09. The balance was about $6500 ($6900) was the limit.
Of course now it's over the limit because of interest/late fees.
Other than my statements saying, "Your Account is Seriously Past Due", nothing else seems to be happening.
I haven't answered a single phone call, though.

interesting. mine is about that same amount, and the situation is similar. Never received a call from Discover. BOA, Citi, Chase and Amex all became realistic after 3 or 4 months of missed payments. Discover, OTOH, even days before charge off never offered less than 15% interest with no forgiveness of past fees or interest which effectively made their account a 50% account.
I believe in the UK, if you come to terms with 75% of your creditors, the terms are imposed upon the other 25%. The would have come in handy. In my case, Discover's hard-ball payed off for them as I was able to avoid bankruptcy (at least so far) thanks in particular to Amex giving me two years interest free. Citi and BOA gave me 5 year, low interest payoffs. All free cash over the next six months is earmarked for Discover.
Should the economy re-collapse and civil disorder break out, Discover . . . never mind . . .
