    Question about lawsuit

    Does a lawsuit show up on a credit report even if it has been settled? If not, can a prospective employer still find out about it?

    Also, how long does it typically take between the time a complaint has been filed and the time you get served?

    I've never seen a lawsuit show up on a credit report. Judgments, on the other hand, are reported on there. I suppose your employer could find out if somebody told them or if, just having nothing better to do, your boss decided to go down to the courthouse or get on pacer and search for your name in the party index.

    How quickly you get served after a suit is filed is dependent on a number of things: how easy/hard you are to find, how agressively the plaintiff pursues getting you served, etc. In most states and in federal court, they have 120 days to serve you or they have to get an extension of time or file a new lawsuit.
    Pay no attention to anything I post. I graduated last in my class from a fly-by-night law school that no longer exists; I never studied or went to class; and I only post on internet forums when I'm too drunk to crawl away from the computer.

      Thank you MSbklawyer for the quick response. I am hoping to settle before we get served. BTW, I am in CA and the suit was filed by Zwicker.

        Why do you want to settle if you're filing for bk?

          I'm not filing bk for a variety of reasons, so will need to settle.
