    Questions about Garnishments

    Have a few questions about garnishments. Residence is Tennessee.

    #1. Would a garnishment stop if the employee was no longer working for the company? Specifically, if wages were being garnished, the employee quit, then came back a month/year later...would the garnishment still be in place?

    #2. If we live in one state...employer is in another state...and place of employment is in yet another state...what steps would a creditor need to take to garnish our wages? For example...live in TN, employer based out of FL, work in TX. Tennessee would always be our residence...but employer and place of employment are generally different.

    #3. If employer is constantly changing (every 3-6 months), would a creditor generally go through the hassle of garnishing wages again?

    #1. Yes. If the employee no longer is employed, then they could not deduct from the employees paycheck. In this situation specifically, if the employee left and came back - then the wage garnishment order would have to be reissued to the employer as the employer would have to report (to the court) that the employee had terminated (either by choice of employee or employer) their employment.

    #2 If my research is correct, it would be state the individual resides in and state the court action was taken.

    #3 Depends strictly on the agressiveness of the holder of the Judgement. They would have to go through the motions each and every time to file the docs with the court to garnish wages. Would be up to them. I would think not, but again - these CA's are scum and most likely would do anything to get money they now legally can get with a judgement.
