    Sample Bankruptcy Letters

    Hi, Everybody.

    Just most others on this forum, I am thinking of filing bankruptcy. However, I am willing to settle with my creditors. The money is not the issue. I can easily pay them. However, the problem is that the creditors are NOT willing to give me something in writing agreeing that they will report the accounts in a positive manner once payment is received. They basically just want their money and are not willing to give ME anything in exchange.

    So.....I thought that it might be a good idea to send them a letter either from an actual attorney to call their bluff, i.e., if they think that I am right about to file Chap. 7, that might be an incentive to accept my terms in writing.

    Does anyone have any sample bankruptcy attorneys letters.

    I am confused......If you can easily pay off your debts, why are you thinking of filing bk???

    If you can easily pay off your debts and have gotten behind, then, no, they shouldn't give you something in return.

    I don't want to sound mean or rude, but I think you need to supply a little more info.....

    Any one else have thoughts on this???

    By the way, I don't think you will find anyone here that is willing to help you with any type of fraud. And, without more info, that is what I am getting from this. Maybe I am just tired and not understanding, but I don't think so....

      I have a relative that is willing to loan me the money to pay off these bastards. BUT in return, I want the negative information deleted from my credit reports. And the companies are not willing to do that. I assumed that a letter from an attorney stating that I'm thinking about filing bankruptcy might be an incentive for the companies to agree to my terms. I don't believe that I indicated anything about fraud. I used the term "actual" attorney. [even though "playing a fast one" on a collection agency would be like robbing the mob]. At the end of the day, I'm more concerned with providing a roof over my children's heads NOT about the "fib" that I told to some collection agent.

        I would simply file bankruptcy...you are risking the relationship with a good relative by borrowing money to pay them bastards off, and "them bastards", ain't going to do $hit for your credit report...and I wouldn't believe them even if they said they would.

        It won't be the end of the world. Get discharged, and then if you need money down the road for an emergency expenses and cannot borrow the money, then you can ask this very nice relative if they will loan you money.

          I tried to negotiate with my creditors and they were completly inflexible. I told them that if I couldn't work something out I would have to file for BK. They basically said to go ahead.

            "Go ahead?" Do you have this on tape or in writing? If so save it for the Judge.

              I wrote letters to 6 of my creditors, all sent me back form letters that said, we appreciate your business and value you as a customer, however after reviewing my account they felt 30% was a fair rate. I kept the letters just in case I need them in court.

                They're not bluffing and you shouldn't be either if bk is a real consideration.
                Creditors will not agree to PFD. They'll settle your account for less but they want change the credit reporting.
                If bk is a realistic option, save the threats and just file.Don't send letters that could come back to haunt you in your bk. You don't want to give creditors any incentive to start poking around looking for the source of this money or, examining your cc statements for any hint of substantial abuse.

                  Creditors are NOT GOING TO WORK WITH YOU............ take it from all of us who KNOW............. been there, done that first........before bankruptcy.

                  And above all, creditors are not going to report to the credit bureau what you are asking of them.... they will report what is fact!!

                  Spare you family member, file BK and get a clean slate.....
                  best route you can go under the circumstances.....
