    Collections question (pacer)

    Would a law firm check pacer before filing a lawsuit aginst you for credit card debt? Checking pacer to see if the person has filed for bankruptcy? Just wondering?

    They had better, otherwise it's free money for you for the automatic stay violation. (your lawyer, if he is on the ball, would write them a nastygram and offer to settle for $xxx.)
    filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

      I not filing for bankruptcy but just wonder if this is S.O.P. for them. Why file a lawsuit if the person just filed for bankruptcy but don't they notify creditors now of bankruptcy by the internet? Or is it is U.S. Mail?

        Not necessarily. If you filed for bk, the credit card company would have received electronic notification the same day, as would any parties associated with that debt, ie the law firm that would be filing suit.

        If the credit card company was not listed in the filing, and them nor the legal firm had knowledge of the filing, then filing a suit against you would not be an enforceable violation of the stay. Once they found out, the suit would be dropped, and any further collection efforts by them would then be a violation.
