    Can creditors find out if my checking account is a joint account?

    A credit card company had their atty's file a lawsuit against me, but the judge dismissed it w/o prejudice because it was filed at the wrong venue. I want to try to work out a payment arrangement with this creditor so they do not refile the lawsuit, until I can pay my bankruptcy atty and get the Chapter 7 filed. I have a checking account that I very rarely use, so I was thinking about setting up the payment arrangement with this account, however, it is a joint account with my husband. (The creditor does not know that I have a husband).

    Should I use this account to pay the creditor or would it be wise to open up an account only in MY name?

    I have no problem with you using an existing account, however if a suit is filed and judgment is awarded, make sure that any money in that account is money that you can afford to have seized.

      Why not use that settlement money towards paying your bk lawyer.
      Why try and settle a debt that'll be discharged in bk?
