    Now I'm confused

    I got postcards and letters in the mail yesterday that my place was going to be sold 3/3/08.

    If there is an automatic stay, and per my attorney no one has even requested to get said stay lifted, how have these people gotten my name or my property? That date or that it will be up for a foreclosure sale?

    Is it just based on the fact I filed for BK?

    If the information you received in the mail was not from the court, sheriff, lender or your attorney then it's frivilous garbage! These "trolls" look at county records and look for the BK filings and that's how they get your information.

    Discharged - 02/16/2006
    Case Closed - 11/08/2007

      I filed before the mortgage company could foreclose on me. I know this is crap mail. If there is a stay, then wasn't the mortgage company not supposed to file? There have been no requests to lift the stay.

        The date may be bogus as well. The Sheriff sets the sale date, not the lender.......so........if the stay has not been lifted and the lender has not completed the foreclosure, then that date is probably meanigless as well.

          Ok. Just seemed retarded. Plus yesterday I got a collection call too. Starting to rain now eh?
