We filed Chapter 13 in June and were already 3 months behind on our house payment. Before confirmation on the 13 we switched to a chapter 7. We have not made a house payment since February 08 and do not plan to keep the house. We would however, like to live here as long as possible. I am apprehensive about only having a short time to move. Since we are so far behind, can HSBC accelerate the foreclosure process? What kind of timeline shoud I expect? Thanks for the help!!!

My parent sstopped paying in Feb as well, and got the evict notice last week, have to be out by 12/12. However they did not have a BK in process either. YOur foeclosure is delayed by the automatic stay, unless the lender has filed to have the stay lifted in order to proceed with the foreclosure. Have you gotten notice for the auction sell yet? They got theirs in Sept and just barely have to be back out next week. Your atty should be able to tell you if the stay's been lifted
