    Foreclosure and the ex

    My ex (still married but separated & divorcing) is the mortgagee on a residence where are both listed on the deed as owners. Property is in NC. There was a date set for today for the house to be sold, but the lender is offering to allow more time for something to be worked out. I want to do a deed in lieu with cash for keys. Problems are these:

    1. No one lives there or has in 4 months. I don't think the bank knows that though.
    2. My ex is not very cooperative.

    How would you approach the attorney for the lender? I wouldn't have anything on my credit report as far as foreclosure if that was the case, right?

    We had ask for a deed in lieu but was told since we was upside down (negative equity) it could not be done.

    My husband is also the only one on our home loan.
    You shall take your name off anything other loans where you have Joint account like credit cards etc.
