    Waiting on foreclosure

    We converted from a chapter 13 to chapter 7 on November 22. We have not made a house payment since March. We would like to live in our house as long as possible, but I don't want someone to come up and say "You have one week to get out!!"

    Won't I get legal papers in the mail when they start the foreclosure process, (which will give me at least some idea about how long I have)?

    Yes, you will receive everything related to your foreclosure. You can also check your county records as well to stay on top of things. Also, keep watching the Sheriff Sale's as this will allow you to see the sale date. I tell anyone going through foreclosure to make an effort to be moving out of the home on or about the date of the Sheriff Sale because the eviction timeline after the Sheriff Sale is hard to determine.

    Discharged - 02/16/2006

      Yes, you will get legal papers. Has the bank sent you a notice of default? They should have by now.

      We quit paying our mortgage in June, got our default letters in August or Sept., and about a month later, the trustee sent a notice of sale for 12/5. Later we got another letter stating the sale would be postponed until 1/16.

      In your shoes, it probably would be wise to move before the date of the sheriff's sale. You wouldn't want to come home one day from the grocery store to discover your locks have been changed!

      You can check on www.foreclosure.com and find the auction date of your home.
