    OK, so reading this makes me feel a little better but here goes anyway.....I filed BK last year, had 100K discharged but kept the 1st/2nd mtg....this year times have been tough...falling behind on both...10 days on first....3 months on 2nd. i applied for a loan modifcation on the 2nd in Dec, still no answer but the monthly bill keeps coming and at that same time i have a crissis that prevents me from sending anything to them(heating bills-car repair-medical).

    so a couple of questions

    1. can i get a loan Modification on my first as well? or since i am not far behind yet will they not do anything


    2. In my area, I keep hearing commericals for attorneys that will barter with your mortage holder for a better rate/loan mod..even lower amount owed....is this a scam?.....most of my finicail problems stem from getting deeper into debt with scams and i want to avoid those....thanks in advance

    Hi, Paul. I'm pretty new here, but I just went back and read your previous posts. It looks like you've really been struggling and the BK didn't help you that much... Have you checked out the forum threads here for life after BK?

    I don't know your details, it looks like you're working a lot, does your DW work? It's tough, but to succeed going forward it makes sense to sit down and set up a realistic budget (maybe you have one?), including emergency funds for auto repairs, medical, etc. Sinking funds for irregular payments like propane and insurance... And when you have a budget set up using real numbers - then go from there to decide what you can keep, if you need more income, what can go, etc. Sorry I can't really help you, how sad to read that you are still struggling after the BK.

      Paul, when you say you kept the 1st and 2nd, did you reaffirm or do a ride through?

      If you reaffirmed, that means you can not just walk away. But it does not stop you from trying to get a modification.

      If you did not reaffirm, you can just walk away from your house.

        I wish I would have known about this forum before i filed. i reaffirmed, so I guess that meansi am stuck with them. We want/intend to sell as we are not upside down, but in this market we won't get what it is worth and then getting into something i can afford with a BK will be tough. WF is on the machine with an answer about my request for a modification, so maybe it is good news, I just am a bit gun-shy about talking with creditors right now. Thanks all.
