    Mortgage credit problems - how long to stay in house?

    This is an excellent video that explains how this entire mortgage credit mess all started.

    I learned a lot from that video.

    As I said this morning, I was served this morning from my mortgage company. I have to respond within 20 days. I have a 1st and 2nd mortgage with Ditech.

    How long have people stayed in their houses with their mortgages foreclosed through Ditech? How much can they offer when they give cash for keys?

    I don't believe that the fact that your mortgage is with Ditech makes much difference in how long the foreclosure process takes.

    The major factor is which Florida foreclosure attorney Ditech uses and how aggressively you challenge the foreclosure. Florida foreclosure attorneys are swamped right now and some are more aggressive than others.

    However, anyone in Florida who challenges their foreclosure lawsuit should be able to delay foreclosure for at least a year right now.

      I don't understand why they let people manipulate the courts like that. Why can't the attorney just get a judgment against you within 2-3 weeks? Why do the courts drag it out for so long for? When they meet you, they do everything so fast anyway, so why the big delays?

      I know this is great for us to be able to stall them, but I don't see why a judge would allow anyone to stall. They make it easy for tenants to burn landlords with stall tactics like this.

      What does a letter look like when you answer a summons? Is it a form or do you draft an essay?

        It's not really manipulation at all. There is a rather rigid procedure to be followed when one defends a lawsuit. That procedure takes time. A judge isn't free to create his own procedure. That would lead to chaos.

        Everyone should defend themselves in a lawsuit. If you don't, you lose right away.

        Foreclosure and debt collection attorneys love it when defendants don't even bother to respond to service of a complaint. Why should we make it easier for the attorneys to do their job. They wouldn't do the same for us.

        You need to learn more. Get the book Represent Yourself In Court and you'll better understand how the process works. You'll also learn to appreciate the process.
